RULES AND REGULATIONS FOR THE MANUAL RECONCILIATION OF ELECTION RESULTS, AND
MANUAL CANVASS OF HARD COPIES OF ELECTION RETURNS AND CERTIFICATES OF CANVASS
IN CONNECTION WITH THE MAY 10, 2010 NATIONAL AND LOCAL ELECTIONS.

WHEREAS, Resolution No. 8919 promulgated on May 13, 2010, provides, among other things, for the manual reconciliation of election results caused by the uploading into the municipal canvassing and consolidation system of Final Testing and Sealing results instead of Election Returns;

WHEREAS, there are areas where candidates are still to be proclaimed due to the non-transmission of election returns and certificates of canvass to the municipal and provincial canvassing and consolidation system;

WHEREAS, there is a need to provide the rules and regulations to guide the municipal, provincial and national boards of canvassers in the conduct of the manual reconciliation of election results, and in the manual canvass of election returns and certificates of canvass;

NOW, THEREFORE, by virtue of the powers vested in it by the Constitution, Omnibus Election Code, Republic Act No. 9369 and other election laws, the Commission RESOLVED, as it hereby RESOLVES, to promulgate the following rules and regulations in the conduct of the manual reconciliation of election results, and in the manual canvass of election returns and certificates of canvass:

  1. CITY/MUNICIPAL BOARD OF CANVASSERS (C/MBOC) shall:
    1. On the basis on its copy of the electronically-generated Statement of Votes By Precinct (eSOVP), determine whether there are precincts reflecting ten (10) votes or less. If there is no precinct result reflecting ten (10) votes or less, manual reconciliation shall no longer be conducted.

    2. If there are precincts reflecting ten (10) votes or less, conduct manual reconciliation of results. For this purpose, obtain a copy of the Final Testing and Sealing (FTS) results, and a copy of the Election Returns (ER) for the precinct/s affected. If the precinct reflects zero (0) vote, obtain a copy of the ER for the precincts affected.

    3. Obtain its copy of the electronically-generated municipal certificate of canvass (eMCOC), and deduct therefrom the votes reflected in the FTS results. The difference between the eMCOC and FTS results shall then be added to the results reflected in the ER.

    4. If the precinct reflects zero (0 for all candidates, add to the eMCOC the results reflected in the ER, without deducting anything from the eMCOC.

    5. In all cases, indicate the individual ERs and the individual FTS results, if any, in the Reconciliation Report (Annex "A") to be attached to the manually-prepared municipal certificate of canvass (mMCOC) which shall be submitted to the provincial board of canvassers (PBOC) concerned.

    6. In case there are candidates still to be proclaimed after completion of the manual reconciliation, canvass the hard copies of the ERs generated by the PCOS that were not inputted into the municipal CCS by adding to the mMCOC the resuits reflected in the ERs, and proclaim the winning candidates based on the final ranking.

    7. In case no manual reconciliation was conducted, canvass the ERs that have not been inputted into the municipal CCS by adding to the eMCOC the results reflected in the hard copies of the ER, and proclaim the winning candidates based on the final ranking.
  2. PROVINCIAL BOARD OF CANVASSERS (PBOC) shall:
    1. Upon receipt of the mMCOC, deduct from the electronically-generated provincial certificate of canvass (ePCOC) the results reflected in the eMCOC received by the provincial CCS. The difference between the ePCOC and eMCOC shall be added to the mMCOC submitted by the MBOC. In all cases, indicate the individual eMCOC and the individual mMCOC in the Reconciliation Report (Annex "B") to be attached to the manually-prepared provincial certificate of canvass (mPCOC) which shall be submitted to the national boards of canvassers (NBOC) in the Commission, for the canvass of votes for Senator and Party-List, and the Congress for the canvass of votes for President and Vice-President. The same procedure shall be adopted in case of affected cities comprising one or more legislative districts.

    2. In case there are candidates still to be proclaimed after completion of the manual reconciliation, canvass the hard copies of the mMCOCs that were not inputted into the provincial CCS by adding to the mPCOC the results reflected in the mMCOCs, and proclaim the winning candidates based on the final ranking.

    3. In case no manual reconciliation was conducted, canvass the mMCOCs that have not been inputted into the provincial CCS by adding to the ePCOC the results reflected in the hard copies of the mMCOCs, and proclaim the winning candidates based on the final ranking.
  3. NATIONAL BOARDS OF CANVASSERS (NBOC) shall:

    Upon receipt of the mPCOC, deduct from the electronically-generated national certificate of canvass (eNCOC) the results reflected in ePCOC received by the national CCS. The difference between the eNCOC and ePCOC shall be added to the mPCOC submitted by the PBOC. In all cases indicate the individual ePCOC and the individual mPCOC in the Report (Annex "C") to be attached to the manually-prepared national certificate of canvass (mNCOC).

  4. COMMON PROVISIONS
    1. The members of the boards concerned shall affix their signatures and thumbmarks on the Reconciliation Reports to be accomplished.

    2. The boards of canvassers concerned shall notify the watchers, candidates, representatives of political parties, and citizens arm of the date, time and place of the conduct of manual reconciliation of election results, and shall commence and complete the manual reconciliation of precinct results, and canvass, and proclamation of winning candidates under the following schedule:

Let the Supervisory Committee implement this Resolution.
