RESOLUTION No. 8919

IN THE MATTER OF THE IMPLEMENTATION OF COMELEC RESOLUTIONS
NUMBERED 8912 AND 8914 IN CONNECTION WITH
THE MAY 10, 2010 NATIONAL AND LOCAL ELECTIONS.

WHEREAS, on May 11 and 12, 2010; the Commission promulgated Resolutions Numbered 8912 and 8914, entitled "In the Matter of Lowering the Threshold of the Canvassing and Consolidation System in Connection with the May 10, 2010 National and Local Elections" and "In the Matter of Correcting Files Uploaded to the Consolidation and Canvassing Servers Using the Final Testing and Sealing Results in Connection with the May 10, 2010 Synchronized National and Local Elections", respectively;

WHEREAS, in the implementation of Resolution No, 8914, the transport to Manila of the canvassing and consolidation (CCS) laptops will hamper the transmission of election results to the National Boards ur Canvassers, both of the COMELEC and of the Congress due to distance of the cities/municipalities where the CCS laptops affected will be coming from;

NOW, THEREFORE, by virtue "of the powers vested in it by the Constitution, Omnibus Election Code, Republic Act No. 9369 and other election laws, the Commission RESOLVED, as it hereby RESOLVES, as follows:

  1. In the case of CCS containing the final and testing sealing results instead of the results reflected in the election returns:
    1. If the CCS has not yet transmitted the city/municipal certificate of canvass to the next level of canvassers:
      1. If the CCS laptop will arrive in Manila by May 13, 2010, the discrepancies between the final testing and sealing results against the actual results contained in election returns shall be reconciled at the Project Management Office, Palacio del Gobernador, Intramuros, Manila;

      2. If the CCS laptop will not arrive in Manila by May 13, 2010, manual reconciliation of the discrepancies shall be conducted at a later date to be set by the Commission. In the meantime, Resolution No. 8912 shall be implemented, whereby the Regional Election Directors will provide the usernarne and password to the board of canvassers concerned to enable the latter to:
        1. Lower the canvassing threshold;
        2. Proclaim the winning candidates not affected by the discrepancy; and
        3. Transmit the certificate of canvass to the next level of canvassers.
    2. If the CCS has already transmitted the city/municipal certificate of canvass to the next level of canvassers, manual reconciliation of the discrepancies shall be conducted on a date to be set by the Commission.
  2. In the case of CCS containing correct election results, but there are still election results to be received by the CCS:
    1. If the CCS has not yet transmitted the city/municipal/provincial certificate of canvass to the next level of canvassers, Resolution No. 8912 shall be implemented, whereby the Regional Election Directors will provide the username and password to the board of canvassers concerned to enable the latter to:
      1. Lower the canvassing threshold;
      2. Proclaim the winning candidates not affected by the results still to be received by the CCS; and

      3. Transmit the certificate of canvass to the next level of canvassers.
    2. If the CCS hus already transmitted the city/municipal/provincial certificate of canvass to the next level of canvassers, manual reconciliation shall be conducted on a date, to be set by the Commission, in order to complete the canvass of all election results for the city, municipality or province, as the case may be.

Let the Supervisory Committee implement this Resolution.
