The SC seem to have gotten lost in giving the 'assumptions' in favor of the accused rather than in favor of the victim Roland Chapman to make the crime murder instead of only homicide. Suddenness and swiftness of the attack on the victim should have been more than enough to make the shooting by the accused on the victim Chapman a crime of murder and not homicide. Deliberation and planning is not enough to overcome suddenness and swiftness without notice or warning of the attack by shooting the victim. Neither chance encounter, etc. Too technical already for the Court to have gone so far in error.
