Hi! Atty,
I wonder if you could help me with my questions.
1994 I was married to a guy who forced me by saying he is not going to let me leave the country without marrying him. We have 2 kids and he is a drug addict shabu user until now, so I am afraid when he said he will kill my kids if I don't marry him before leaving the country. So I did! just to make sure I can scape from him and I endorsed my kids to my parents. Supported the kids financially every month. While working abroad I met my new husband the following year and we are now married for 16 years with 2 children as well!

Now the question is my first husband is not after me but my mother and my siblings are black mailing me! I am now living in US and has green card. Is there's a chance my mother and siblings can just create trouble for me while I am abroad? Please let me know as they are really nasty influential people! I have invested a lot in Philippines and end up nothing they took it all and leave my kids without. Please help me answer this question! Thanks a lot in advance!

Hi, I just want to ask about my marriage status.. We got married last 2008 without the concent of his parents upon checking sa NSO it was been registered. I am 28 years old and He is 32.

my question is our company is the exclusive distributor of the said product which has trade secrets and patents, we've been delivering the said products since 2009 after winning the bidding and complying all the requirements needed to be eligeble, and suddenly by the last quarter of december 2011, we simply found out that there was other company not known to our principal who were awarded by the BAC to deliver the said products. my question is do we have the right to retrieve the products from the other party? can we retrieve the products or intercept the products from delivery if not yet being receive and sign by the end user even if the said product was already in the establishment where the product shall be used?

do we have the right to fight for this?

I would like to ask. I am the second wife. My husband filed an annulment before the second marriage. He got the decision of nullity sometime in November 1999. He is not aware that copies should be provided to nso. He got also the Certificate of Finality which needed to be filed to nso as well. In year 2000, we got married knowing that his previous marriage had been annulled. The marriage was registered to NSO. My husband went to US for work. we had a child. In year 2006, i went to nso in Manila to get a copy of his previous marriage's license and found out that in Manila, he is still legally married to his wife because the cert of finality wasnot registered. Is our marriage in 2000 valid or not? Is my husband considered single up to now? do we need to remarry?

"The Judiciary may not have the power of the sword, may not have the power of the purse, but it has the power to interpret the Constitution"

A very dangerous doctrine....

Sa pag-iinterpret kasi sa ating Constitution. Ang equivalent nito ay:

a.) Lawmaking - Gumagawa ka ng Batas

Sole duties and functions dapat ng Legislative Branch. Hindi ng Judicial Branch.

Sole duties and functions dapat ng Constitutional Convention (Con Con or Constitutional Assembly (Con Ass) Delegates. Hindi ng Judicial Branch.

Ganito tuloy yung nangyari....

"Two months immediately before the next presidential elections and up to the end of his term, a President or Acting President shall not make appointments, except temporary appointments to executive positions when continued vacancies therein will prejudice public service or endanger public safety."

"Each legislative district shall comprise, as far as practicable, contiguous, compact, and adjacent territory. Each city with a population of at least two hundred fifty thousand, or each province, shall have at least one representative."

"A public officer or employee shall, upon assumption of office and as often thereafter as may be required by law, submit a declaration under oath of his assets, liabilities, and net worth. In the case of the President, the Vice-President, the Members of the Cabinet, the Congress, the Supreme Court, the Constitutional Commissions and other constitutional offices, and officers of the armed forces with general or flag rank, the declaration shall be disclosed to the public in the manner provided by law."

REPUBLIC ACT NO. 6713

Section 8 of RA 6713, also known as the Code of Conduct and Ethical Standards for Public Officials and Employees.

Kaya panukala ko....

Kapag natuloy yung pagbabago sa ating Constitution o Charter Change.

Bago ma-ratified by a majority of the votes cast in a plebiscite ang ating magiging Constitution.

Syempre sila (Framers) yung tama.

- "Separation of state powers: executive; legislative; judicial"

Di ba sa Theory ni Montesquieu

Executive

Who implement or execute the law.

Legislative

Who make, pass, and repeal the law.

Judicial

Who interprets and applies the law.

Sa akin naman....

Executive

Who implement or execute the law.

Legislative

Who make and pass the law. But before it became the law. It should be Interpreted.

Also it can repeal the law

Judicial

Who applies the interpretation of the law.

(Yun lang... Thanks for reading. To God alone be all the Glory sa naisip ko. Dahil binigyan Niya ako ng Wisdom at Idea. To Reform our Constitution.

Dear Atty,
Thank God I found this site and I pray you will be able to help me with my queries regarding my annulment case.

I filed my annulment 2008 as NONE APPEARANCE before I went back working in Thailand as a caregiver..the following year, it was declared ''annuled'' BUT the problem arise when I was about to register it in the place (Florida Blanca, Pamp) where I had my ''church wedding'', when the Civil Registrar said he cannot register it because only the ''church wedding'' was annuled and nothing was declared/stated about my ''civil wedding''..he said, there should be a decision on both rights (church and civil)..
I went back to the person whom I entrusted the filing of my case and she said because I did not submit any evidence about my civil marriage..Granted, that I did not submit..In the first place, she did not tell me to do so and though I did not submit any legal papers, there was an attachment INFO on the side of my ''Marriage Contract''stating there that I was married in civil rights on this date and year...so why then, they did not see this?...I was asked to submit all legal papers regarding my civil wedding..After I complied with all the necessary requirements, she submitted it again in RTC Branch 7 in Paniqui, Tarlac for ammendment but I was told that I will have to wait because the Judge is on vacation that time..I waited, ok ! but up to this time, I got NO ANSWER..The last time I talked to the person I entrusted my case, she said I was the cause of the delay and that she wanted me to go personally in Paniqui to inquire because she was busy herself..WHY, ME?..i don't even know anyone there, besides, I entrusted her to work on it ..I paid everything she asked me to pay and this is what I got...I waited for the longest time..I have been separated for 10 yrs now and I believe I have the right for my own happiness since my x husband already has his own family with 3 grown up kids in which his eldest was even older than my youngest daughter, only to prove that he was already having an affair even during our own marriage.
Please help me ATTY..I am no longer working and I was just an ordinary servant of God in JIL..I spent almost my earnings to get my annulment and until now I haven't got my case done..I will appreciate your kind office in whatever help you can extend to me.
Thanks and Godbless....Mench

I went back to the person whom I entrusted the filing of my case and she said because I did not submit any evidence about my civil marriage..Granted, that I did not submit..In the first place, she did not tell me to do so and though I did not submit any legal papers, there was an attachment INFO on the side of my ”Marriage Contract”stating there that I was married in civil rights on this date and year…so why then, they did not see this?…I was asked to submit all legal papers regarding my civil wedding..After I complied with all the necessary requirements, she submitted it again in RTC Branch 7 in Paniqui, Tarlac for ammendment but I was told that I will have to wait because the Judge is on vacation that time..I waited, ok ! but up to this time, I got NO ANSWER..The last time I talked to the person I entrusted my case, she said I was the cause of the delay and that she wanted me to go personally in Paniqui to inquire because she was busy herself..WHY, ME?..i don’t even know anyone there, besides, I entrusted her to work on it ..I paid everything she asked me to pay and this is what I got…I waited for the longest time..I have been separated for 10 yrs now and I believe I have the right for my own happiness since my x husband already has his own family with 3 grown up kids in which his eldest was even older than my youngest daughter, only to prove that he was already having an affair even during our own marriage.
Please help me ATTY..I am no longer working and I was just an ordinary servant of God in JIL..I spent almost my earnings to get my annulment and until now I haven’t got my case done..I will appreciate your kind office in whatever help you can extend to me.
Thanks and Godbless….Mench
