Hi Atty Fred, I hope you can give me advice on this issue. Here is the case,

They're not living on the same roof for almost 6yrs now. Since may problema na talaga pagsasama nila for many reasons na di magkasundo. The guy is something Silahis pero di nya mailabas or tinatago lang. When you see the situation parang ginagawa nyang panakip butas yung family nya to hide what he is. Many times na din syang nahuli for a sign of pagiging Silahis. Un din siguro reason why di sila mgkasundo. Talo pa yung girl kung dumakdak, and iba ang attitude nya. We can say may Psychological Incapacity yung guy. Kahit sa mga kids nya he never act like a father. All he did to his wife is to turn her down ganito, ganyan... Now the girl is fed up and feels a lot of pain and want to end their marriage for her to move on. He confront his husband and he refuse for the annulment for many reasons like property and other things. What will be the best move for this case... PLS HELP!

Atty, in this case po mga ilang months/years matatapos yung proceedings if ever ayaw nung isang party. And how much would it cost? Thanks a lot...

I have an outstanding loan from a Financing Company. This is my second time to avail of their loan services, but due to some unavoidable circumstances I failed to pay all the monthly amortizations via PDCs I have issued to the company. Thus, I was informed that a BP 22 case has been filed against me. I haven't received any subpoena or warrant from the court since I moved to another residence. Mails concerning my outstanding loan from the financing company were either directed to my mother's residence or to my husband's office mostly threats that they would be publishing my picture on the newspaper. Just recently, a letter was delivered at my mom's residence stating that should I fail to make arrangements with their office within a week upon delivery of the letter, they would be posting my picture in two leading newspapers for four consecutive weeks (a sample for said notice re: pending BP 22 case with my picture has been attached). Is this really possible? And if a case has been filed against me, should I not make arrangements with them in court and not in their office? I really need your advice on this.

Thank you.

Hi Atty Fred,
Just have some inquiry. My wife and i already separated for almost a year now. Before we part ways we signed marital settlement agreement (MSA). My question now, do our MSA is valid or admissible in court in case my wife file a petition for annulment?. Please help, thanks.

i found trouble on the applicability of "jurisdictional amount" involving action for quieting of title over real property. the assessed value of the property is below 100k. The action was filed in the RTC believing that action for quieting of title is an action incapable of pecuniary estimation. This is because the main issue involved is the determination of the existence of the cloud of doubt that cast upon one's title and its removal. On one hand, the rule provides that the jurisdiction over action involving title to real property shall be determined by its assessed value. Which is which?

Good Day!
A referendum would be an 'end all, be all' on this subject.
The reasons why this law needs to be passed presented here are:
1. promiscuity of MEN
2. inequality of the law because of religion
3. abusive nature of the husband
4. absentee spouse
5. mental capacity to keep a marriage

and believe or not..

6. cause we're 1 of only 2 countries who doesn't have one!

the list could go on..

Though some of the above reasons are undeniable and would merit the passing of this law, I would like to bring to attention that we have existing laws which could address several specific concerns such as promiscuity and abuse. These laws can be amended if some groups feel they are insufficient. I feel the problem points to our country's incapacity to enforce our laws (especially to the more privileged). What good will it do us if we pass another law which would be bent sideways, thrown up and down by our 'creative' countrymen? If we continue to present to the masses actors, men in uniform, wealthy individuals, mayors, governors and even a president who are above these laws; why should the masses be made to abide to these laws?
